The Health and Safety at Work etc. Act 1974 and the Management of Health and Safety at Work Regulations 1999 places legal obligations and responsibilities on emplyers, for those that might be affected by the Company's undertakings. The law applies to all businesses, whether they are a small private company or a large global concern.
Regulation 5 of the Management of Health and Safety at Work Regulations 1999, requires organisations to create and implement an effective and systematic approach to the management of health and safety, which includes appropriate arrangements for planning, organising, controlling, monitoring and reviewing preventative and protective measures. These arrangements must be recorded in writing where five or more people are employed.
Employers are required to appoint one or more persons to assist them to achieve and maintain legal compliance with the Management of Health and Safety at Work Regulations 1999. This can be achieved by employing someone competent or an external health and safety advisor can be used.
